Specialist FCA Defence Law Firm Bark & Co Solicitors Represent Individuals in Alleged Conspiracy & Money Laundering Investment Scam Case Prosecuted by the Financial Conduct Authority
Bruce Rowan and David Simmons are among those who have been charged by the FCA with multiple counts of conspiracy. Robert Sweeney, David Simmons and Justin Russell are also accused of money laundering.
The four individuals are accused of running an unauthorised investment scheme that defrauded investors of PS3.9million.
The FCA claims that from 1 May 2015 to 23 July 2019 the defendants conspired with 2 companies, Hanover Merchant Capital UK Ltd. and Liberty House Capital Ltd., to defraud UK investors by falsely representing that their money was going towards water extraction, bottled water production and the expected returns.
The defendants are due to appear in Westminster Magistrates’ Court, Westminster, on April 3, 2024.

Hanover Merchant Capital UK Limited, Liberty House Capital Ltd, were both well-established companies with London offices and were part of an international group.
- The capital raised by investors will be used to pay for the costs or invest in a real water extraction, and bottled-water production, and/or
- Capital raised by investors will be covered under a valid insurance policy and/or
- Investors will receive annuities and return generated from the capital invested.
The Fraud Act 2006, section 2, and the Criminal Law Act 1977 section 1, paragraph 1 punish conspiracy to commit fraud through false representation.
Money laundering is a crime under section 327 of Proceeds of Crime Act, 2002. It is punishable by indictment with a fine or up to 14-years’ imprisonment.
