We are acting for a client (BA) who has been charged with two co-defendants following an HMRC criminal investigation.

It is alleged that between December 2016 and May 2020 our client submitted false VAT returns regarding the trading activities of his company, 1966 Ltd, to make a dishonest gain of £1.3m, and in addition that between August 2019 and February 2020 he and a co-defendant (BA’s wife) submitted false VAT returns regarding the trading activities of another company, Racing Red Ltd, to make a dishonest gain of £142k.

It is claimed that BA set up 1966 Ltd (trading as Speed of London) as a bogus company in order to defraud HMRC of a significant amount of money through VAT repayments. The purpose of the company was ostensibly to hire out high-value, luxury cars to people for special occasions. This enabled BA to claim to HMRC that high-value cars had been purchased at a significant cost to the business, and to claim the VAT back on the purchases because he had either made very few sales or none at all; a key part of the alleged fraud was the use of false and forged purchase and sales invoices. BA subsequently set up a second car leasing company with his wife to carry out a similar fraud.
