R v Saini – Insider Dealing26.06.2013
At the time the largest FSA prosecution into insider dealing relating to spreadbetting on derivative trades concerning share price movements….
Dina Patel is a Senior Solicitor within the Bark&co’s criminal team and has been part of the firm for 12 years. She has extensive experience in all aspects of criminal law including murder, large scale drugs importation, sexual offences, serious fraud, money laundering, insider dealing and confiscation matters.
Dina has been described by others as ‘tenacious’ and ‘diligent’ and is very popular with clients, due to her personable nature. Cases of note include R v Clark; a matter involving an illegal share-pushing operation, conducted from call centres situated in Spain, where £7 million worth of shares were transacted, using “Gordon Gekko” style sales techniques. Dina represented Mr Clark, who was acquitted at Trial of any wrongdoing.
In Operation Tulipbox, Dina was involved in the first ever Carbon Credit Fraud prosecuted in the UK. Dina represented a Director of one of the companies, who along with 6 others was charged with cheating the HMRC of £39 million in just 69 days of trading. She also assisted with Operation Inertia, which was one of the largest and most complex mobile phone tax frauds uncovered, where individuals were charged and convicted of trying to steal £176m from the public purse. She has also assisted with Operation Weeting, the high profile News of The World phone hacking case and Operation Saturn, where the defendants were accused of obtaining confidential and price-sensitive information from investment banks about forthcoming takeover bids.
In Operation Aardvark, Dina represented the main Defendant in the case, who was charged along with one other, with a series of high value mortgage frauds. It was alleged that the two knowingly falsified and inflated the earnings of applicants upon mortgage applications, in order to secure mortgages, which otherwise would have been refused, had the true nature of the financial details been provided. In total, false applications to the value of £46,000,000 were applied for in this way, with £36,000,000 worth being approved by the Banking Institutions. The Prosecution offered no evidence against the Defendant at Trial, as a number of flaws had been exposed in the Prosecution case, through persistent disclosure applications by the Defence.
Following her success in Operation Aardvark, Dina is now a specialist in the area of mortgage fraud matters and is currently working on Operation Aquamarine and Operation Spectrum.
