Bark&co instructed Jonathan Laidlaw QC of 2 Hare Court as Leading Counsel with Mr Jonathan Polnay of 5 King’s Bench Walk as Junior Counsel to defend.

Mr Fitch-Holland and Mr Chris Cairns (the former New Zealand cricket captain) had been charged with doing an act tending and intended to pervert the course of public justice in relation to their successful libel trial against Lalit Modi.

In 2010 Lalit Modi, the former head of the Indian Premier League cricket tournament, tweeted that Cairns had been involved in match fixing. Cairns in response successfully sued Modi for libel which was the first ‘Twitter’ libel trial to be heard in England
